What is Surrogacy?
Surrogacy is a method of Assisted Reproductive Technology (ART), where a woman who cannot conceive or carry a pregnancy takes the help of another woman, the surrogate mother, who carries the pregnancy to term, delivers the baby, and hands over the child to the intended couple after birth. The process involves in-vitro fertilisation (IVF) or ICSI using the eggs and sperms of the intended couple to create embryos, which are then transferred into the uterus of the surrogate mother. The resulting child is biologically 100% related to the intended couple; there is no genetic contribution from the surrogate mother.
Surrogacy is useful in which conditions?
- MRKH syndrome – a condition where the uterus is absent since birth
- Asherman syndrome – damage to the uterine lining (endometrium) due to scarring
- Uterine conditions such as multiple fibroids or adenomyosis
- Hysterectomy or uterus removal due to medical reasons
- Repeated IVF failures (RIF – Repeated Implantation Failure)
- Medical conditions like uncontrolled diabetes, hypertension, kidney or liver disease that make it unsafe to carry a pregnancy
- Recurrent miscarriages

Legal Status of Surrogacy in India
Surrogacy laws vary globally. While the USA allows commercial surrogacy, countries like France, Spain, Italy, and Germany completely prohibit it. Nations such as the UK, Ireland, and Denmark adopt a middle-ground approach, permitting altruistic surrogacy under strict guidelines.
India has established clear legal boundaries with the Surrogacy (Regulation) Act, 2021, which was passed in June 2022. The Act strictly permits only altruistic surrogacy, where the surrogate mother is reimbursed solely for medical and pregnancy-related expenses. No monetary compensation is allowed beyond this.
The Act outlines specific guidelines for:
- Intending couples
- Intending women (widows or divorcees)
- Surrogate mothers
The intending mother must obtain a medical certificate of infertility from the appropriate authority. In addition:
- Both the intending mother and the surrogate must secure eligibility and essentiality certificates from the designated local government authority.
- The intending couple must also receive a court order before proceeding with surrogacy.
The law permits only people of Indian origin to access surrogacy in India. Intending couples must be married, infertile, and must not have any living biological or adopted children (unless the child has a disability or serious medical condition).
Birth Certificate
In accordance with the court order, our experienced fertility team ensures that only the names of the intended mother and father appear on the baby’s birth certificate. These are issued by the Delhi Municipal Council and carry the apostille seal, making them legally valid globally.
The Surrogacy Process
- Initial consultation, detailed discussion, and blood testing of both partners
- Psychiatric and emotional evaluation of the surrogate and her family
- Blood tests and ultrasound of the surrogate to evaluate the uterine lining
- Ovarian stimulation of the patient using gonadotropin injections, with simultaneous preparation of the surrogate’s uterus
- Egg retrieval followed by IVF or ICSI
- Embryo culture and transfer into the surrogate’s uterus
